Hi,

I'grand currently in search for a company (ltd) proper noun and I found one which I like and consists of two latin words of generic meaning.

My commencement footstep was to search online, where I found a couple of companies who are using some kind of combination of these 2 words (none of them is UK-based), but both of them are completely unrelated to my field. I'm providing web design/development services, and I'one thousand about to release a few SaaS products (subscription-based spider web applications) which will exist owned by the visitor I'thou about to form.

I used the company name search tool provided by the companieshouse.gov.uk website and I didn't find any company registered in the UK which is using these 2 words together in its name. There are a few though, who are providing services similar to mine and are using merely 1 of these words.

My side by side step was to check the trademark search tool provided by the ipo.gov.britain website. There, although I didn't find any trademark which is using both the words I'yard going for, there are some registrations for each one of them individually, and I recollect some of them are falling into the my form of services (from a quick search I recall I belong to grade 42).

Is it legal to use as my visitor proper name let'southward say "Hello World" and trademark that for my grade of services, even though in that location is a trademark for "Hello" by someone, and "World" by someone else for the same form?

Both of these words are normal latin words, none of them is a made up word.

Any unique combination of 2 words only applies to category it is registered in. Think of Band Aid. It tin be a sticky plaster and a pop concert.

Thanks for the reply, but I don't think it answers my question:

I desire to trademark (as an example) "Hello World", which will refer to the name of a company which will provide web design services (the actual registered name of the company can be different, I know that).

Can I practice it if someone has already trademarked the word "World" and refers to a visitor which provides the same kind of services as mine?

I tried to trademark a name of my publication which is a two word name. There was somebody already holding the trademark of the offset word in the category in which I wished to register and they declined my application because of the previous trademark owners right to 'expand' on the utilise of his existing name rights. This was virtually 7 years ago now, I think the rules may not be the same though.

Interestingly I've merely looked at the IPO website and the trademark expired for the mark I had a problem with in 2012. In 2009 some other marker was registered in the aforementioned category with the same name, then the IPO didn't appear to be bothered nearly this then that there were ii holders with the same name. I may have another go.
